General Terms and Conditions of Sale (GTCS)

These General Terms and Conditions of Sale (hereinafter “GTCS”) govern the sale of Artigli-branded products (hereinafter “Products”) marketed by Distribuzione Carillo S.r.l., with registered office in Nola (NA), CIS di Nola – Isola 7, Lotti 773/776, VAT no. 04169341213, through the website https://artigli.it

All contracts of sale concluded through the Site are governed by these GTCS, which form an integral and substantial part of every Order and are deemed specifically approved by the Customer pursuant to Articles 1341 and 1342 of the Italian Civil Code.

The applicable GTCS are those in force on the date of the Order.

Orders placed through the Site are deemed to be concluded by private Customers for personal use.

1. Introduction

1.1 These GTCS govern the purchase of Products by electronic means, and the submission of an Order implies their full acceptance by the Customer.

1.2 The contract of sale is concluded as set out in clause 3.4, without prejudice to the exercise of the right of withdrawal within the terms provided by law.

1.3 The Customer declares that they have carefully read and accept these GTCS before proceeding with the purchase.

2. Definitions

  • Consumer: a natural person who purchases for purposes unrelated to their trade or profession

  • Professional: a natural or legal person who purchases in the course of their business

  • Customer: a Consumer or a Professional

  • Contract: a contract of sale concluded online

  • Order: a purchase proposal submitted by the Customer

  • Working day: any day other than Saturdays, Sundays and national public holidays

3. Conclusion of the Contract

3.1 Contracts of sale are concluded exclusively in Italian.

3.2 The information on the Site constitutes an invitation to treat and not a binding offer.

3.3 The Customer must complete the electronic order form following the instructions provided.

3.4 The Contract is concluded only when the Shipping Confirmation is sent by Distribuzione Carillo S.r.l.

3.5 Distribuzione Carillo S.r.l. reserves the right to accept or refuse the Order without the Customer being entitled to make any claim.

3.6 If payment has already been made for Orders that are not accepted, the amount will be refunded in full.

4. Prices

4.1 All prices are inclusive of VAT.

4.1-bis For deliveries outside Italy, the prices of the international price list shown on the Site when browsing from those countries apply.

4.2 Prices may be changed at any time, without affecting Orders already confirmed.

4.3 In the event of an error in the price shown, the Customer will be informed and may choose to:

  • confirm the Order at the correct price

  • cancel the Order with a full refund

5. Shipping Costs

  • Shipping in Italy: € 7,50, free on orders of € 70,00 or more

  • Shipping to the European countries served: € 15,50

  • Return or exchange: € 7,50

  • Parcels over 8 kg or in more than one package: € 10,00

6. Payment

6.1 Payment is made at the time of the Order.

6.2 Accepted methods:

  • Credit, debit and prepaid cards (Visa, Mastercard and the other cards shown at checkout)

  • PayPal, Apple Pay, Google Pay, Shop Pay

  • Payment in instalments with Klarna and Scalapay

6.3 Payment methods may be changed without notice.

7. Delivery

7.1 Deliveries are made in Italy and in the European countries that can be selected when placing the order.

7.2 Shipping times run from confirmation of payment.

7.3 Distribuzione Carillo S.r.l. is not liable for delays due to:

  • unavailability of the Products

  • force majeure

  • events beyond its control

8. Guarantee and Complaints

8.1 Consumers are covered by the legal guarantee of conformity provided for by the Italian Consumer Code.

8.2 The legal guarantee lasts 24 months from delivery. To exercise it, the Consumer must report the defect within 2 months of discovering it, by writing to ordiniweb@artigli.it.

8.3 Where repair or replacement is impossible, the Customer may request:

  • a price reduction

  • termination of the contract

9. Protection of Personal Data

Personal data is processed in compliance with the applicable legislation and the Privacy Policy available on the Site.

10. Use of the Site

The Customer undertakes to:

  • provide truthful information

  • refrain from placing fraudulent orders

  • use the Site exclusively for lawful purposes

11. Amendments to the GTCS

Distribuzione Carillo S.r.l. reserves the right to amend the GTCS.
Amendments apply to Orders placed after their publication.

12. Right of Withdrawal

The Consumer may withdraw within 14 days of delivery, without having to give any reason.

  • Registered customers: through the “Orders” area

  • Guest customers: by e-mail to ordiniweb@artigli.it

Collection of the return is arranged by Distribuzione Carillo S.r.l. at a fixed cost of € 7,50.

13. Effects of Withdrawal

The refund will be made within 14 days of notification of the withdrawal, to the same means of payment used for the purchase. Distribuzione Carillo S.r.l. may withhold the refund until the Products have been received. If the withdrawal concerns the entire Order, the standard delivery charges are also refunded. The cost of collecting the return remains payable by the Consumer. If the Products are returned damaged or without their tag, the refund may be reduced in proportion to their diminished value. 14. Governing Law and Jurisdiction

These GTCS are governed by Italian law.

  • Court of jurisdiction: Nola

  • For Consumers, the court of jurisdiction provided for by the Italian Consumer Code remains applicable
